The terms that govern MCT, the logistics platform produced by LBYA AB and licensed to the operators who run on it, Jarida Africa among them.

Acceptance of these terms

By accessing MCT (through this site, a portal, an application or an interface provided by an operator running on the platform) you agree to these terms. Where your organisation has a separate written agreement with LBYA AB, that agreement governs and these terms fill the gaps it leaves.

What MCT is

MCT, short for Malaika Control Tower, is logistics software produced by LBYA AB. It is not a carrier, a freight broker, a customs agent or a marketplace, and it does not move cargo, hold goods or clear consignments. Those activities belong to the operators who license the platform, Jarida Africa among them. Any transport contract you enter is with that operator, not with LBYA AB.

Deployments and operators

MCT is deployed per operator. Each deployment carries its own branding, its own domain and its own data, and the operator decides which modules are enabled and who may use them. If you reached the platform through an operator's branded portal, that operator is your counterparty for service, support and commercial terms; these terms cover the software beneath it.

Accounts and access

Access is granted through an account issued by an operator or by LBYA AB. You are responsible for the credentials issued to you, for activity carried out under them, and for telling the issuing party promptly if you believe they have been compromised. Do not attempt to reach data belonging to another user, tenant or deployment, to disrupt the service, or to probe it beyond the access you were granted.

Data and responsibility

Operational data entered into a deployment (loads, documents, fleet records, payroll and the rest) belongs to the operator whose deployment holds it. LBYA AB processes that data to run the platform and on the operator's instructions. The operator remains responsible for the accuracy and lawfulness of what it records, and for the arrangements it has with its own customers, drivers and partners.

Availability and change

The platform is developed continuously. Modules, interfaces and behaviour may change, and maintenance may interrupt availability. Where a written agreement sets service levels, those apply; absent one, MCT is provided without any availability commitment. Material changes affecting how an operator works are communicated to that operator rather than announced here.

Intellectual property

MCT, its software, design, documentation and the MCT name and marks are the property of LBYA AB. Licensing a deployment grants a right to use the platform, not a transfer of rights in it. Operator brands shown on a deployment (names, logotypes and marks) remain the property of those operators and are used with their permission to identify their configuration.

No warranties

Except where a written agreement says otherwise, MCT is provided "as is" and without warranties of any kind, express or implied. Figures the platform reports (distances, transit times, duty positions, forecasts and analytics) are derived from recorded data and are aids to judgement, not guarantees. Verify anything you intend to rely on commercially or for compliance.

Limitation of liability

To the maximum extent permitted by law, LBYA AB is not liable for indirect or consequential loss, loss of profit, loss of business or loss of data arising from use of the platform, and its total liability is limited to the fees paid for the deployment in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

Governing law

These terms are governed by the laws of Sweden, the jurisdiction in which LBYA AB is established, and the Swedish courts have jurisdiction over disputes arising from them. This does not displace any mandatory protection available to you under the law of your own country of residence.

Changes to these terms

These terms may be revised as the platform develops. The version published here is the one in force, and the date shown above records when it last changed. Continued use after a revision means you accept it.
